Terms and Conditions
  

By submitting work for copyright registration the registrant acknowledges that he or she has read and understands and agrees to the following terms and conditions.

1. Copyright registration with SongCopyright.org provides unlimited lifetime registration as described in these Terms and Conditions.

2. It is understood that registering with SongCopyright.org is for the purpose of establishing a submission date of material submitted documenting the song details including title and the name or names of the person(s) or entity submitting the material and is is also understood that such aforementioned details will be maintained on a database for the purpose of verification of the registrant's claim to copyright ownership of the submitted song and that no other services are implied or offered by SongCopyright.org.

3. It is understood and accepted that SongCopyright.org is an independent witness in the business of documentation and certification of the submission dates and content of song compositions and that it is not affiliated with the US Copyright Office or any other government Copyright Office nor does it register any song submissions with the US Copyright Office or any other government Copyright Office. 

4. It is understood that nothing in the SongCopyright.org website should be construed as offering legal advice or representation. It is further understood and accepted that SongCopyright.org does not offer legal advice or legal services of any kind, nor protection against claims of whether the material submitted was legally assigned to a third party or whether the material was composed earlier than its submission to SongCopyright.org, or the identity of the submitter or any other matter. It is further understood that, should the registrant and/or writers seek legal advice or services regarding copyright law or any other legal matter, they must do so on their own and through an attorney duly licensed in the state or country where they reside. 

5. By submitting composition(s) to SongCopyright.org the registrant agrees to hold harmless and indemnify SongCopyright.org, and its owners, from and against any third party claim arising from or in any way related to the use of SongCopyright.org's services, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature. SongCopyright.org's sole obligation under this agreement is to provide evidence of the date of submission, name of the registrant as supplied and the contents of submitted material as provided, and nothing else. 

6. SongCopyright.org has never lost any submitted material, but in the unlikely event any such submission is lost or otherwise damaged due to failure to exercise reasonable care or for any other cause or reason whatsoever, it is agreed and understood by all parties that the liquidated damages for said loss is and shall be no more than the registration fee originally paid by the Registrant. 

7. In the event of cessation to trade for any reason SongCopyright.org undertakes and warrants to use its best efforts to provide contingency measures to ensure that, where reasonably practicable, appointed agents are identified and made responsible for the complete fulfillment of any and all existing registrations but no claim or guarantee is made that such transference will be made or will be practicable or possible but notwithstanding and at no time shall SongCopyright.org require or request any additional fees from the registrant for continuence or extension or fulfillment of the agreed service. The term "Lifetime Registration" when used in relation to services offered by SongCopyright.org signifies that the services outlined in the Terms and Conditions will continue for so long as SongCopyright.org remains in existence and shall not at any time expire or require any additional action or fee to extend the continuence of registration.

8. The Registrant shall ensure the clarity and accuracy of all data and information and material supplied and shall check any Certificates provided and notify SongCopyright.org within 28 days of any inconsistencies or errors which shall be effected free of charge and a new Certificate prepared. Excepting updates to Registrant contact information no other changes will be permitted. Certificates will be available for viewing, verification and printing online and the online certificate system is updated by SongCopyright.org at the end of each calender month and new registrations are added to the database in the month following receipt. Registrants may print or save their certificates from the website. SongCopyright.org will not post or mail certificates to entrants. Certificates are dated to the day of submission.

9. SongCopyright.org may at any time without notifying the Registrant make any changes to its services which are necessary to comply with any applicable safety or any other requirements or which do not materially effect the nature or quality of its services. For storage and data integrity purposes, SongCopyright.org may create back up copies of registered works. Submitted 'original' copies may be discarded due to storage requirements, but only after a secure back up has been made. 

10. Duplicates of submitted works will be provided on the official and formal request of bona fide legal firms representing the Registrant in legal cases of copyright dispute. It is understood that works will not be provided under any other circumstances nor to any other persons, including the Registrant or the named writers, and such copies will demonstrate the full content of the registered item(s), but may be produced on a medium other than that originally submitted.

11. SongCopyright.org shall be entitled to vary its fees from time to time and these will be published or made available to the Client on request and shall apply to any new transactions.

12. SongCopyright.org shall be entitled to refuse any further transactions with a Registrant or refuse to provide any services for a Registrant and shall also be entitled to terminate any registrations or services offered or provided where the Registrant is suspected of abusing or fraudulently using the services or has not made full payment or for any other reason whatsoever at SongCopyright.org's sole and absolute discretion. 

13. SongCopyright.org warrants that it will provide its service using reasonable care and skill and shall have no liability for any loss, damage, costs, expenses or any other claims for compensation arising from any data information or instructions supplied by the Registrant which are incomplete, incorrect, inaccurate, illegible or in the wrong form or arising from their late arrival, non-arrival, failure to transfer correct information, verify receipt of data (where applicable) or any other fault of the Registrant, this includes any issue relating to the validity of items submitted and timely notification of changes to Registrant's contact details.

14. SongCopyright.org shall not be liable to the Registrant by reason of any representation or any implied warranty condition or other term or any duty at common law for any loss of profit or any indirect special or consequential loss, damage, costs, expenses or other claims (whether caused by the negligence of SongCopyright.org, its servants or agents or otherwise) which arise out of or in connection with the provision of any services or their use by the Registrant and the entire liability of Songcopyright.org under or in connection with song registration shall not exceed the amount of Songcopyright.org's charge for the provision of the registration service.

15. SongCopyright.org shall not be liable to the Registrant or be deemed to be in breach of contact by reason of any delay in performing or any failure to perform any of its obligations in relation to services if the delay or failure was due to any cause beyond its reasonable control.

16. The Registrant warrants that any data or other information provided and its use by SongCopyright.org for the purpose of providing its services will not infringe the copyright or other rights of any third party and the Registrant shall indemnify SongCopyright.org against any and all loss, damages, costs, expenses or other claims arising from any such infringement.

17. The Registrant warrants, with regard to all items the Registrant submits to SongCopyright.org for the purpose of registration, that the Registrant is the copyright owner of those items, or that the Registrant is acting directly on behalf of the copyright owner of those items.

18. The Registrant warrants that all items submitted are suitable for purpose and for the provision of the service and understands that SongCopyright.org will not and cannot make any judgement regarding the suitability of submitted material. SongCopyright.org will not listen to or examine or read any song material, files, CDs or any other submitted material and accepts all material submitted on an "as received" basis and on the understanding that the Registrant has checked the material and is satisfied with its validity, correctness and suitability before submission. In cases of copyright dispute SongCopyright.org will supply the original file copies "as received".

19. SongCopyright.org's service is solely as an independent witness and is intended as an aid in the proof of copyright claims. No guarantee, warranty or liability is given or implied and the responsibility of proving copyright remains at all times with the Registrant. SongCopyright.org will not enter into any legal issues on the Registrant's behalf other than providing copies of certificates and/or copies of the work as described elsewhere in these terms and conditions.

20. The Registrant understands and agrees that the registration fee specifically covers the provision of initial administration, account set up, and storage and duplication services involved with Registration and other services at the time of the transaction/sale. The Registrant understands and agrees that excepting claims made within 30 days of the date of Registration, in the event of any loss, corruption or damage, or in the event of liquidation or cessation whether due to SongCopyright.org's failure or by any other cause whatsoever, that the financial liability will not exceed 10% of the registration fee.

21. The Registrant shall be entitled to terminate registration by giving not less than three months notice to SongCopyright.org but should be advised that this shall terminate the Registration and that all items deposited for the purposes of carrying out its Service shall not be returned and that no fee payments will be refunded for early termination.

By submitting work for registration the registrant acknowledges that he or she has read and understands and agrees to the above terms and conditions.
